Welcome to the Bright Coders service (the "Service"). The Terms of Use and conditions in this document (the "Terms of Use") apply when You view or use the Service via our website located at [https://brightcoders.com] (the "Site"). Throughout the Terms of Use, Bright Coders may be referred to as "Bright Coders", "we", "us", or "our". "You" includes both You, the student user, and your parent or legal guardian who, if You are under the age of 18, has consented to your use of the Services and your agreement to these Terms of Use, as applicable. "Member" means users who are active subscribers to the Services, as set forth in more detail below, including students who use the Services and/or their parents or legal guardian who consent to the use on their behalf, as applicable. IF YOU ARE A PARENT OR LEGAL GUARDIAN AND YOU PROVIDE CONSENT FOR YOUR CHILD TO REGISTER ON THE SITE OR THE APP TO USE THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE IN RESPECT OF SUCH CHILD’S USE OF THE SITE, AND THE SERVICES. THE SERVICES ARE NOT AVAILABLE TO: (A) ANY USERS PREVIOUSLY SUSPENDED OR REMOVED FROM THE SERVICE BY BRIGHT CODERS, OR (B) ANY PERSONS UNDER THE AGE OF 13 (OR UNDER THE LEGAL AGE OF CONSENT IN YOUR COUNTRY) WHOSE REGISTRATION HAS NOT BEEN APPROVED BY A PARENT OR LEGAL GUARDIAN.

Please review the Terms of Use carefully. By accessing or using the Service, You signify your agreement to the Terms of Use. If You do not agree to the Terms of Use, You may not access or use the Service. If You are a parent or legal guardian and You provide consent for your child to register for the Service, You agree to be bound by these Terms of Use in respect of your child’s use of the Service.

PRIVACY POLICY Bright Coders respects the privacy of the users of the Service. Please refer to our Privacy Policy (found here: the "Privacy Policy") which explains how we may collect, use, and disclose your personal information. By accessing or using the Service, You signify your agreement to the Privacy Policy.

ABOUT THE SERVICE The Service allows You to learn about computer science and programming, anywhere. Users work with instructors via video conference to learn a range of topics, including Python and other programming languages. The Bright Coder website, which may be accessed via the web is the main hub for users to access and use the Service, and allows users to attend classes, see an overview of current and future coursework, assemble and publish projects and many more features in the future.

REGISTRATION; RULES FOR USER CONDUCT AND USE OF THE SERVICE You must be a resident of the United States and of legal age to form a binding contract to register for the Service. If You are under 18 years old and thus, are not yet of legal age to form a binding contract, your parent or legal guardian must read these Terms of Use and agree to them before You use the Service. If You are under 18 and your parent or legal guardian has consented to your use of the Service, then both You and your parent or legal guardian agree that You will only use or access the Services in accordance with these Terms of Use. The Service is not available to (i) any users previously suspended or barred from the Service by Bright Coders or (ii) any persons under the age of eighteen (18) years old whose usage of the Service has not been approved by a parent or legal guardian.

By using or registering for the Service, You represent (a) that You have not been previously suspended or barred from the Service by Bright Coders; (b) that You are either (i) at least 18 years old or (ii) your parent or legal guardian has consented to your use of the Service; and (c) that your registration and your use of the Service is in compliance with any and all applicable laws and regulations.

As a user of the Service, You will create a personalized account (an "Account") which includes an email and a password to access the Service and to receive messages from Bright Coders.

You agree to notify us immediately if You become aware of any unauthorized use of your Account. We will not be responsible for any liabilities, losses, or damages arising from or related to any unauthorized use of your Account.

You verify that any contact information provided to Bright Coders, including, but not limited to, your e-mail address, mobile phone number and mailing address (if required) is true and accurate. By providing your email address and using the Service, You hereby affirmatively consent to Bright Coder’s use of your email address for messages, in order to: ● perform and improve upon the Service, ● facilitate the carrying out of our Service, ● provide You with information or promotions about product updates or improvements, as well as new and existing features of the Service, ● provide You with information and reminders regarding your registration, changes and updates, service outages or alterations, and ● provide You with updates from other Members of our community.

These message may include, among other things, push notifications and other reminders delivered through our website. Standard message, data or other charges from your wireless carrier may apply. You may opt-out of receiving emails from us by emailing [[email protected]] and specifying You want to opt-out of emails.

Membership Each user must complete the enrollment form for the Service, which may be completed online or by telephone interview with a Service representative. You will need to provide a valid credit card at the time of enrolling for the Services. Membership is billed on a monthly basis, unless otherwise agreed at enrollment, based on the particular membership plan chosen by You. We may terminate your use of the Service if the membership is not paid for in a timely manner. You can cancel the Services at any time by logging into your Account and canceling the Services.

BILLING AND AUTOMATIC RENEWAL Bright Coders subscriptions renew automatically using the payment details on file for your Account. If You enroll for recurring classes, You acknowledge and agree that we are authorized to use the payment information on file for the tuition renewal amount. Until You cancel or the courses You enrolled in end, Bright coders will bill in advance of each month and your subscription will renew monthly on the first day of each month as the date of the first paid class, unless otherwise specified.

You may cancel your subscription at any time as described in the "Cancellation and Refund Policy" section of these Terms of Use, but your subscription will remain active until the last day of the month that You have already paid for in advance.

All fees and applicable taxes, if any, are payable in United States dollars. You are solely responsible for the payment of, and shall pay when due, all applicable sales and use taxes and similar fees now in force, enacted or imposed in the future on the delivery of the Services and/or any related transactions (except for taxes assessed on our net income or personal property). If for any reason we pay any such taxes, duties or excises, You will reimburse us for such taxes, duties or excises, other than taxes on our net income. We may include any such fees or taxes in addition to the monthly subscription fee in your monthly payment as required by applicable law.

MAKE-UP CLASS POLICY You understand that there will be no cash refunds or credits issued for missed classes and there will be no makeup classes issued for no-shows to an existing class. If You need to reschedule an existing class, You must do one of the following at least 24 hours prior to that class: (i) reschedule your class directly in your Bright Coders website. You must schedule a makeup class with your current instructor from the list of available classes set forth on our Site.

CANCELLATION AND REFUND POLICY You may cancel your Bright Coders subscription at any time. If You have already paid for classes beyond the time You request a cancellation, we will reimburse the fees for the classes after the time of cancellation.

For our team to begin to process a cancellation, we require that Members complete the steps below: ● Request a cancellation for [email protected]. ● Please note, your cancellation request may take up to 3 business days to reflect in your Account once submitted, and You will receive a confirmation email from [email protected]. once the cancellation is fully processed.
